PARTICIPANT AGREEMENT & TERMS AND CONDITIONS

These are the Terms and Conditions under which Cúrate Trips LLC, doing business as Cúrate Travel ("Cúrate Travel," "we," or "us"), a limited liability company organized under the laws of the State of North Carolina, USA, offers culinary travel experiences. By registering and paying a deposit for a Tour, you are entering into this Participant Agreement with us. Please read these terms carefully before making any payment.

1. Booking Your Tour

Reservations and Payments

(a) To secure your booking, a deposit of 25% of the total Tour cost per person (a “Deposit”) is required. If you are booking within 90 days of departure, full payment is required at the time of booking.

Payment may be made by most major credit cards or by bank transfer to Cúrate Trips LLC. Bank transfer fees are borne by you. Your final payment date will be listed on the Confirmation Invoice.

(b) Payment to Cúrate Travel constitutes full satisfaction of your financial obligation for the Tour. All Tour arrangements are fulfilled on your behalf by Cúrate Travel and its contracted service partners.

(c) If a Tour is full, we will accept Deposits on a standby basis. If space becomes available, you will have the choice of joining the Tour by paying in full or opting to receive a refund of your Deposit.

(d) At the time of booking, you will be asked to confirm the number of members in your party and provide full passenger details and a copy of each member's passport.

(e) Special Requests (dietary requirements, food allergies, room preferences, flight seat preferences, or accessibility needs) must be indicated in writing at the time of booking. We will use reasonable efforts to arrange for Special Requests to be met, but cannot guarantee they will be fulfilled. A Special Request does not constitute a term of your contract unless confirmed in writing by Cúrate Travel.

(f) Upon receipt of your Deposit, Cúrate Travel will send you a Confirmation Invoice. A binding contract comes into existence on the date on which we issue the Confirmation Invoice. By making a booking, you confirm that you (and all members of your party) are at least 21 years of age and accept these Terms on behalf of yourself and all members of your party.

(g) Most Tours require a minimum number of participants. Please see the specific conditions set out for each Tour.

(h) If the total balance is not paid by the due date, we reserve the right to cancel your travel arrangements and retain your Deposit.

2. What Is Included and Excluded

Pricing

All Tour prices are quoted in US Dollars (USD) per person, based on double occupancy, unless otherwise stated, and include applicable US taxes. Prices include programming, planning, and operational charges. We reserve the right to adjust Tour prices to cover increased costs, other taxes, or currency fluctuations. We will not provide a cost breakdown for individual Tour components.

Inclusions

• Domestic flights where indicated (economy class unless otherwise specified; business/first class supplements may be available)
• Standard baggage allowance per carrier policy (details provided in your final itinerary voucher)
• Round-trip airport transfers by private vehicle at Tour cities
• Hotel accommodation in rooms with private facilities, inclusive of service charges and local taxes
• Meals as specified in the Itinerary ('Full Board' = breakfast, lunch, and dinner; 'Half Board' = breakfast and dinner)
• Sightseeing with private group guides; museum and attraction entrance fees where applicable
• Transportation in premium coaches throughout the Tour
• Cúrate Travel-hosted Tour leadership throughout
• Gratuities at hotels and restaurants (excluding gratuities to drivers, local guides, and Tour Directors — see Exclusions)

Exclusions

The following are not included in your Tour price:

• International airfare to and from the Tour destination
• Travel insurance (strongly recommended — see Section 8)
• Flight insurance (must be purchased separately at time of booking)
• Passport and visa fees, health certificates, or immigration requirements
• Airport departure taxes (unless otherwise noted)
• Excess baggage charges
• Gratuities to drivers, local tour guides, and Tour Directors (driver gratuities are handled collectively; others are at your discretion)
• Meals not listed in the Itinerary
• Sightseeing not listed in the Itinerary
• Personal expenses including laundry, phone calls, room service, and optional activities
• Any government levies or taxes introduced after Tour publication

Single Travelers

Tour prices are based on double occupancy. Single travelers will be required to pay the single supplement fee stated for each individual Tour.

Extra Arrangements and Hotel Bookings

Cúrate Travel can assist with pre- and post-Tour hotel extensions and additional services through our preferred partners. Please contact us at info@travelwithcurate.com for details.

3. Cancellation by You

(a) All cancellations must be submitted in writing by the person who made the initial payment, and emailed to info@travelwithcurate.com with written confirmation of receipt. Cancellations are effective on the date received by Cúrate Travel. Recorded delivery is strongly recommended.

The following cancellation fees apply, calculated as a percentage of the total Tour cost per person. Your Deposit will applied to applicable cancellation fees. In certain cases, a particular Tour may have higher cancellation fees, which will be disclosed to you prior to booking.

• More than 90 days before departure: 25% of total Tour cost
• 90–61 days before departure: 50% of total Tour cost
• 60–31 days before departure: 75% of total Tour cost
• 30 days or fewer before departure: 100% of total Tour cost

Refunds, if applicable, will be processed by bank transfer.

‍(b) Booking Transfers: If a member of your party is unable to travel, it may be possible to transfer the booking to another eligible person, provided written notice is given to us at least 45 days before departure. Transfers require: (i) documentary proof of the reason for transfer; (ii) full details of the replacement traveler; (iii) payment of any outstanding balance. Both the transferor and transferee are jointly liable for all amounts owed. Please note that airlines may charge up to 100% cancellation fees and the full cost of a new ticket. Cúrate Travel makes no guarantees that booking transfers will be possible or not subject to additional fees.

(c) Failure to Join: Your decision not to participate due to travel advisories, fear of travel, illness, or any other reason will be treated as a cancellation. If a flight or other delay prevents you from joining the Tour on the departure date, you will be considered a no-show. No full or partial refund or future credit will be provided, though you are welcome to join the Tour in progress if you choose.

4. Changes by Cúrate Travel

Cúrate Travel takes great care to ensure all Tour information is accurate. However, our tour operator works with independent suppliers and some itinerary elements may change due to local conditions, weather, or other circumstances beyond our control.

Most changes are minor. If a material change occurs before departure — defined as a destination change of more than 100 km, a downgrade in accommodation standard, or a price increase exceeding 5% — we will notify you as soon as reasonably practicable. In such cases, you may: (i) accept the change, (ii) transfer to another available comparable Tour (paying or receiving any price difference), or (iii) cancel and receive a full, prompt refund within 14 days of such notification. If you do not elect to transfer to another Tour or cancel your Tour within 14 days of notification of a material change, you will be deemed to have accepted the change, and any cancellation by you thereafter will be treated as described in Section 3.

If Cúrate Travel cancels a Tour prior to departure for any reason, our liability is limited to a full refund of all payments made to us. We may also offer to transfer your Deposit and any other payments made to us to another available Tour, in lieu of a refund, which you may accept or reject at your sole discretion. We are not liable for any other costs, damages, or losses of any kind. If a Tour in progress must be interrupted or canceled, our liability is strictly limited to a refund of the recoverable cost of any unused portion of the Tour, unless caused by force majeure (see Section 5).

Cúrate Travel will not cancel or amend your hotel arrangements less than 8 weeks before departure, except in cases of force majeure or your failure to pay the final balance.

5. Responsibilities and Limitation of Liability

Cúrate Travel's Role

Cúrate Travel is responsible for marketing, sales, customer communications, and the collection of Tour payments.

Cúrate Travel does not own or directly operate hotels, transportation, restaurants, or other Tour components. These services are contracted and operated by our tour operator or its independent suppliers. As a result, Cúrate Travel is not liable for the acts or omissions of any third-party supplier.

Tour Operator's Role

Our licensed tour operator, Ikusnahi S.L., is responsible for all on-the-ground Tour execution, including contracted suppliers, logistics, and traveler support at the destination. The tour operator carries operational civil liability insurance covering all Tour activities and contracted suppliers. In the event of an incident arising from Tour operations, your recourse is against the tour operator and its insurers.

Force Majeure

Neither Cúrate Travel nor its tour operator shall be liable for any failure or delay caused by force majeure — meaning unusual and unforeseeable circumstances beyond our reasonable control, including but not limited to: war, threat of war, civil strife, terrorist activity, industrial dispute, natural disaster, fire, flood, epidemic, pandemic, adverse weather, power failure, or flight cancellations by airlines.

General Limitation

In addition to the above, neither party is responsible for any injury, financial or physical loss, death, inconvenience, delay, or damage to personal property resulting from acts of God, force majeure, illness, disease, civil unrest, criminal or terrorist activities, overbooking or downgrading of services, food poisoning, mechanical failure, or failure of any transportation to arrive or depart on time. Our liability in connection with air travel, rail, sea travel, or hotel accommodation is limited to the amounts established under the Warsaw Convention (as amended), the 1961 Berne Convention, the 1974 Athens Convention, and the 1962 Paris Convention, as applicable.

ADDITIONALLY, IN NO EVENT WILL CÚRATE TRAVEL BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR INDIRECT COSTS OR DAMAGES. THE LIABILITY OF CÚRATE TRAVEL TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE TOUR WILL NOT EXCEED THE FEES PAID BY YOU TO CÚRATE TRAVEL FOR SUCH TOUR.

THIS LIMITATION WILL APPLY TO ANY LIABILITY, ARISING FROM ANY CAUSE OF ACTION WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF CÚRATE TRAVEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH COSTS OR DAMAGES AND EVEN IF THE LIMITED REMEDIES PROVIDED HEREIN FAIL OF THEIR ESSENTIAL PURPOSE. SOME STATES AND JURISDICTIONS DO NOT ALLOW FOR ALL OF THE FOREGOING EXCLUSIONS AND LIMITATIONS, SO TO THAT EXTENT, SOME OR ALL OF THESE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

6. Price  Policies

(a) Prices may change due to currency fluctuations, fuel surcharges, tax changes, or other external factors. If a Tour price increase of more than 5% of your Tour cost occurs after booking, you may cancel and receive a full refund of all amounts paid, provided you exercise this right within 14 days of notification.

(b) You may choose to pay your Tour in full at the time of booking, in which case your price will be fixed at the rate quoted at that time. To lock in this rate, full payment must be received within 7 days of the Confirmation Invoice date.

7. Your Responsibilities

(a) Please check all details on your Confirmation Invoice upon receipt. Contact us immediately if any discrepancy exists.

(b) All travelers must carry valid travel documentation. It is your sole responsibility to obtain and maintain valid passports, visas, health certificates, and any other required documents. Cúrate Travel will not be liable for any costs or losses arising from failure to comply with entry requirements.

(c) You are responsible for checking in for flights at the correct time and for presenting yourself for all pre-booked Tour components. No refunds or credits will be given for missed flights, missed components, or lost, mislaid, or destroyed travel documents.

(d) If your behavior is deemed by Tour leadership, hotel management, an airline pilot, or any other person in authority to be causing danger, property damage, or persistent disruption to other travelers, we reserve the right to remove you from the Tour. No refund or compensation will be paid in such circumstances.

(e) If you lose personal items during your Tour, please obtain a written report from local authorities to support any insurance claim.

(f) You are responsible for the costs of any damage to accommodation or other charges you incur with suppliers during your Tour. If you fail to settle such charges directly, you authorize Cúrate Travel to charge your payment method for these amounts.

Conduct During the Tour

You are responsible for respecting the authority of Tour leadership and the laws of each country visited. We may exclude you from all or any part of a Tour if your condition or behavior, regardless of cause, is inappropriate, offensive, or poses a hazard or embarrassment. No refund or compensation will be paid in such circumstances.

Assumption of Risk

Travel involves inherent risks. By participating in your Tour and any activities included therein, you expressly assume all associated risks and dangers, and agree to release, discharge, and hold harmless Cúrate Travel, its contracted tour operator, and their respective agents, employees, officers, and directors from any and all claims, liabilities, suits, or demands of any kind arising out of or in connection with your Tour.

Active Tours, Medical Conditions, and Special Assistance

Some Tours include active elements such as hiking or sailing. You are responsible for reviewing the physical requirements of your Tour. You must disclose to us at the time of booking any physical or mental illness, disability, pregnancy, or other condition that may create a health risk for you or others, or require special accommodation. We will make reasonable efforts to accommodate your needs. We cannot accommodate travelers who require physical lifting or assistance onto or off vehicles. If we cannot meet your needs, you must be accompanied by a companion responsible for providing the necessary assistance. We reserve the right to decline or remove any participant whose condition could create a risk to themselves or others, or whose participation would materially impact other travelers' experience.

8. Travel Insurance

It is strongly recommended that all travelers purchase comprehensive travel insurance prior to their Tour departure. Travel insurance is not included in your Tour package price and is your sole responsibility to obtain.

Your policy should provide adequate coverage for, at minimum: trip cancellation and interruption, emergency medical expenses, medical evacuation and repatriation, loss or delay of baggage and personal belongings, personal liability, travel delay, and missed departure. We also strongly encourage you to ensure your international flights are separately insured at the time of ticket purchase.

Please note that our tour operator carries operational civil liability insurance covering Tour activities and contracted suppliers at the destination. However, this coverage is not a substitute for personal travel insurance, which protects your individual travel investment, belongings, and health.

If you have a disability or pre-existing medical condition, please disclose this to your insurer at the time of purchase to ensure you are fully covered. Special insurance may be required for activities such as scuba diving or other high-risk pursuits arranged independently of Cúrate Travel.

Cúrate Travel is not an insurance provider and cannot advise on specific policies. We encourage you to compare policies and select one appropriate to your needs before making any Tour payments. If you choose to travel without adequate insurance, you do so at your own risk.

Please keep your insurance details and emergency contact numbers with you at all times during your Tour.

9. Airlines and Other Suppliers

(a) The terms and conditions of each transportation and accommodation supplier will apply to the relevant component of your Tour. These may be subject to international conventions that limit or restrict supplier liability. Under applicable law, you may have rights to refunds or compensation from your airline in cases of denied boarding, cancellation, or significant delay. These rights are enforceable against the airline directly and do not entitle you to a refund of your Tour cost from Cúrate Travel.

(b) Transport timings are estimates only and are subject to conditions including weather, maintenance requirements, and air traffic control restrictions. They cannot be guaranteed.

(c) Some activities carry inherent risks and a local supplier may require you to sign an additional liability waiver. In rare cases, beginners may need to take paid lessons before using certain equipment.

10. Data Privacy

(a) In order to process your booking and ensure your travel arrangements run smoothly, Cúrate Travel collects personal information including your name, address, passport details, and any special needs or dietary requirements. This information is shared only with suppliers directly involved in your Tour (airlines, hotels, transport companies, etc.) and with public authorities when required by law.

(b) Cúrate Travel operates in accordance with applicable US data privacy law, including the laws of the State of North Carolina. Our tour operator processes traveler data in compliance with the EU General Data Protection Regulation (GDPR) and applicable Spanish data protection law. By making a booking, you consent to the sharing of your data with our tour operator for the purpose of Tour operations.

(c) We take responsibility for implementing appropriate security measures to protect your personal information. Payment card details are retained only for the period strictly necessary to fulfill obligations under these Terms and are securely deleted thereafter.

(d) By participating in a Tour, you consent to Cúrate Travel's use of photographs and video footage taken during the Tour in our marketing materials, without compensation. If you do not wish to be featured in marketing materials, please notify us in writing before your Tour departure.

11. Illness and Disability

Please inform us before booking of any disability or medical condition affecting you or any member of your party. We are happy to advise and help you choose a Tour suited to your needs. Some Tours require a fair degree of physical fitness. We will provide you with a medical disclosure form where relevant. Please consult your physician before booking, particularly if you have circulatory, bronchial, blood pressure, or respiratory concerns, as some destinations involve high altitudes.

12. Complaints and Disputes

(a) If you are unhappy with any aspect of your Tour, please raise your concern immediately with Tour leadership and/or the management of the relevant supplier while on Tour. It is unreasonable to remain silent during the Tour and only raise a complaint upon return. If an issue cannot be resolved on Tour, a detailed written complaint must be sent to Cúrate Travel within 30 days of your return. We aim to respond within 30 days of receipt.

(b) An emergency contact number will be provided in your Tour voucher. In the event of an issue, we strongly encourage you to use it during the Tour to give us the opportunity to resolve the matter in real time. Complaints received after the Tour without prior use of the emergency contact will be considered with special caution.

(c) In the event of a dispute that cannot be resolved amicably, the parties agree to attempt resolution through good-faith negotiation. Either party may then pursue available legal remedies in the courts of the State of North Carolina, USA.

13. Governing Law

This Participant Agreement is governed by and construed in accordance with the laws of the State of North Carolina, USA. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of North Carolina, without regard to conflict of law principles.

14. Accuracy of Descriptions

Every effort is made to ensure that the details, descriptions, and prices in our marketing materials are accurate. However, changes can occur, sometimes at short notice, due to local conditions, supplier changes, or circumstances beyond our control.

Subject to our obligations relating to material changes to a Tour prior to departure described in Section 4 above, Cúrate Travel reserves the right to correct any errors or omissions in its published materials and to amend these Terms at any time as required by changes in law or regulation. Amended Terms take effect upon publication on our website. We recommend checking our website before travel for any updates.

15. Financial Protection

Cúrate Trips LLC dba Cúrate Travel operates as a US-registered travel company. Tour operations are conducted by our contracted tour operator, a licensed Spanish travel company holding all required local licenses, permits, and bonding for the organization of package tours. Financial protection for the operational components of your Tour is maintained by the tour operator in accordance with applicable Spanish and EU travel regulations.
